Le commissaire au lobbyisme du Québec veille au respect de la Loi sur la transparence et l'éthique en matière de lobbyisme et au Code de déontologie des lobbyistes.

Legal framework and Filing and Publication Procedure

Bill 6 entrusts the Commissioner with designing and administering a new simple and efficient platform to replace the existing registry of lobbyists.

Accordingly, the Commissioner is also responsible for:

  • determining the provisions specifying the form and manner for filing returns and notices as well as the manner for keeping the future platform;
  • posting any draft provisions on the Commissioner’s website and allowing 45 days for receiving comments;
  • analyzing the comments and, if required and for any reason the Commissioner deems appropriate, conducting certain follow-ups;
  • publishing the provisions, with or without changes, in the Gazette officielle du Québec.

It should be noted that during the parliamentary committee meeting in May 2019  , the Commissioner had undertaken to make public any comments on the draft provisions posted on the website, subject to any comments deemed unfit for publication.

Prior to consultations, the Commissioner drafted a publication procedure for the manner determined by the Lobbyists Commissioner for keeping the registry of lobbyists entitled Procédure de publication des modalités du Commissaire au lobbyisme relatives à la tenue du registre des lobbyistes   [French only].

Publication

The Commissioner informs the public of the publication of draft provisions by posting a notice in the LobbYscope (the Commissioner’s newsletter) and on the Commissioner’s website and social networks and by issuing a press release.

Following the publication of this notice, the public has 45 days to submit comments.

Comments

To submit comments regarding draft provisions, a person must fill out the form   [French only].

The Commissioner will only consider and publish comments submitted on the form and received within the specified time limit.

Follow-up

All comments submitted in accordance with this procedure will be received and analyzed by the Commissioner, who may, if necessary, contact their author.

Gazette officielle du Québec

The Commissioner publishes the provisions, with or without changes, in the Gazette officielle du Québec.

The provisions come into force on the 15th day after the day they are published.

Lastly, the Commissioner informs the public of the provisions’ coming into force by posting a notice in the LobbYscope (the Commissioner’s newsletter) and on the Commissioner’s website and social networks and by issuing a press release.
